Council met in regular session with?? Mayor David C. Fazio presiding.
Roll Call showed the following members present:
Mahuron, Smith, Seely and Greene (Councilman Mahuron left the meeting at 5:30 P.M.)

Mayor Fazio announced that this was the time and place set for a public hearing on the proposed Ordinance 08-344 Amendment to the Annual Appropriations Ordinance FY-08

The Appropriation Ordinance For The Fiscal Year Beginning October 1, 2007, and Ending September 30, 2008 and Providing An Effective Date.
Moved by SEELY and seconded by SMITH that pursuant to Idaho Code, Section 50-902, the rule requiring an ordinance be read on three different days, with one reading to be in full, be dispensed with that Ordinance 08-344 be considered after reading once by title only.
Roll Call Vote on the motion resulted as follows:

Steve Jenkins? -? Candidate for Nez Perce County Sheriff
Mayor Fazio ? recognized Steve Jenkins.
Steve Jenkins addressed Council and presented his position on current issues concerning the office of Nez Perce County Sheriff’s Department.
Councilmember Greene ? encouraged collaboration not only with the City of Lapwai but also with the Nez Perce Tribal Police.

b.?? Meter Conversion Update ? Lopez purchased drill press and bits to cut holes in meter lids.? Lopez will purchase 35 boxes @ $28 and 70 lids @ $28 for a total $2,940 in FY-08.

Moved by Smith and seconded by Greene to authorize Clerk Turner to transfer $50,000 from the city investment pool to cover budget amendments and prepaid insurance for FY-09,

Mayor Fazio recognized Aaron Keifer
Discussion: agreements with Nez Perce and Asotin County to legally transport solid waste out of the Nez Perce County.
Gwen Carter – Executive Director of Water Resources Nez Perce Tribe
Informed the Council the Nez Perce Tribe and Nez Perce Tribal Housing will be staying with Walco Inc. until the end of October or December 2008.? She advised Walco has not increased sanitation rates for Nez Perce Tribe or Nez Perce Tribal Housing.? Ms Carter indicated Nez Perce Tribe is the owner of the container site, and the equipment at the site.
Council discussion ? City staff and equipment will be available to assist with unloading containers.? Containers can be stored at the City Fire Station yard.
Sanitation Contract will be prepared by City Attorney.
Equipment will be ordered when contract is signed.

Moved by MAHURON and seconded by SEELY that the City of Lapwai Invoice Payable to Progressive Engineering, in the amount of $13,245.00 be approved.
Voice vote on the motion resulted as follows:
YEAS: SMITH, SEELY and GREENE.

B.???? Payment of Accounts Payable as Presented

Moved by SEELY and seconded by SMITH that the City of Lapwai Accounts Payable Checks, in the amount of $58,604.70 as of September 15, 2008 be approved.
Voice vote on the motion resulted as follows:

YEAS: Smith, Seely, and Greene.

Executive Session
Moved by Mayor FAZIO and seconded by SEELY to move into Executive Session in accordance with Idaho Code ?67-2345 (1) (f) pending/potential litigation.
