CITY COUNCIL SPECIAL meeting minutes
November 24, 2008
Council met in regular session with Mayor David C. Fazio presiding.
Roll Call showed the following members present:
Mahuron, Smith, Seely and Greene. Mahuron left at 5:33
Mahuron returned at 6:15
Smith left at 7:47
Smith returned at 7:55
Visitor:
Joel Ristau – Asotin county Landfill
Contract with City of Lapwai and Asotin County Landfill Mr. Ristau is reviewing contract with Jane Risley (Department Prosecutor). Lewiston, Asotin County, Clarkston, Asotin, Garfield County and parts of Nez Perce County all pay $40 per ton at the landfill. City of Lapwai will pay about $70 per ton because they are “new” to the landfill.
Greene – Questions why Asotin County is requiring things from the City’s contractor when the contract with Asotin County is with the City of Lapwai not the contractor for Lapwai?
Mr. Ristau – These items are negotiable.
Mr. Ristau meets with Jane Risley November 25, 2008 and will email Ed – City of Lapwai Attorney, with changes and Ed will forward the new draft contract with requested changes to the Mayor and Council Members.
Executive Session:
Moved by Mayor FAZIO and seconded by Smith to move into Executive Session in accordance with Idaho Code 67-2345 (1) (f) for the purpose of discussing potential litigation.
Roll Call Vote on the motion resulted as follows:
YEAS: Mahuron, Smith, Seely and Greene.

Reconvened at 5:56 P.M.
Moved by Mayor Fazio and seconded by Smith to move into the regularly scheduled special meeting.
